Terms of Service

These Terms of Service (“Terms”) govern access to and use of ShipBio, a website-building and publishing service provided by Zyref, LLC (“Zyref,” “we,” “us,” or “our”). By creating an account or using ShipBio, you agree to these Terms.

1. Eligibility and accounts

You must be legally capable of entering into a binding agreement and at least 13 years old to use ShipBio. If you use ShipBio for an organization, you represent that you have authority to bind that organization.

You are responsible for maintaining the security of your email account and ShipBio session, for all activity under your account, and for keeping your account information accurate. Notify us promptly if you suspect unauthorized access.

2. The service

ShipBio lets you create, host, and manage portfolio websites, project case studies, blog posts, custom domains, newsletter subscriber lists, reader discussions, and related content. We may improve, change, suspend, or discontinue parts of the service. We will make reasonable efforts to provide notice when a material change negatively affects paid features.

3. Your content

You retain ownership of content you submit to ShipBio. You grant Zyref a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify for technical formatting, transmit, and display that content solely as needed to operate, secure, and improve the service.

You represent that you have all rights needed to publish your content and that doing so does not violate law, privacy, publicity, intellectual property, or contractual rights. You are responsible for your published content and for maintaining copies you may need.

4. Newsletter and visitor data

If you collect newsletter subscriptions or other visitor information through your site, you are responsible for providing legally required notices, obtaining valid consent, honoring unsubscribe and privacy requests, and using that information lawfully. You may not use ShipBio to send unsolicited or deceptive messages.

If you enable reader comments, you are responsible for reasonable moderation and for responding to lawful reports or removal requests. Readers must use discussion features respectfully and may control their own post and reply notifications.

5. Domains and third-party services

You are responsible for registering, renewing, and configuring custom domains. Domain registration fees are not included. ShipBio may rely on third-party infrastructure, email, storage, payment, analytics, and certificate providers. Your use of third-party products may also be governed by their terms.

6. Paid plans and billing

Unless a different offer is shown, each newly created website receives a 14-day trial of the highest eligible plan without requiring a payment card. At the end of the trial, the website moves to the Free plan unless you select a paid plan. Your published content remains stored, while premium design features may stop displaying until you upgrade.

Paid plans are billed per website at the price and interval shown when you subscribe. Charges are processed by our payment provider. Subscriptions renew automatically until canceled. You may manage or cancel a subscription through the billing portal; cancellation normally takes effect at the end of the current billing period.

Except where required by law, fees already paid are non-refundable. We may change prices prospectively by providing reasonable notice. If payment fails, we may retry the charge, limit paid features, or move the affected website to a free plan. Content and settings that exceed free-plan capabilities may stop being displayed but may remain stored for a reasonable period.

7. Acceptable use

You must follow our Acceptable Use Policy. You may not misuse the service, interfere with its operation, access it through unauthorized means, or use it to violate another person’s rights.

8. Intellectual property

ShipBio, its software, templates, branding, documentation, and service content are owned by Zyref or its licensors and are protected by intellectual property laws. These Terms give you a limited, non-exclusive, non-transferable right to use the service; they do not transfer ownership of ShipBio intellectual property.

9. Suspension and termination

You may stop using ShipBio at any time. We may suspend or terminate access if you materially breach these Terms, create risk or harm, fail to pay applicable fees, or if required by law. Where practical, we will provide notice and an opportunity to resolve the issue. Provisions that by their nature should survive termination will survive.

10. Disclaimers

ShipBio is provided “as is” and “as available.” To the fullest extent permitted by law, Zyref disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not guarantee search rankings, audience growth, domain availability, or permanent retention of content.

11. Limitation of liability

To the fullest extent permitted by law, Zyref and its members, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business opportunities. Our total liability arising from the service will not exceed the greater of US $100 or the amount you paid to Zyref for ShipBio during the 12 months before the event giving rise to the claim.

12. Indemnity

To the extent permitted by law, you will defend and indemnify Zyref from claims, damages, losses, and expenses arising from your content, your use of ShipBio, or your violation of these Terms or another person’s rights.

13. Changes to these Terms

We may update these Terms. If changes are material, we will provide reasonable notice through the service, by email, or by posting an updated effective date. Continued use after the changes take effect means you accept the revised Terms.

14. General

These Terms and the policies referenced here are the entire agreement concerning ShipBio. If a provision is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization, financing, merger, acquisition, or sale of assets.
